PRIVACY POLICY

Date of Last Revision/Update: August 14, 2017

This Privacy Policy applies to services and information collected by SoftVu on our main website (https://www.softvu.com) and all affiliate websites (“Sites”). This Privacy Policy is designed to ensure that visitors to our Sites understand how and why SoftVu collects and uses information provided by users of our Sites.

SOFTVU INFORMATION COLLECTION POLICY

SoftVu collects and stores the information you provide to us through our Sites. This may include such personal information as your name, the company you work for, business title, postal address, email address, telephone number, marketing preferences, and other information. SoftVu collects only the information necessary to provide our Services to You and/or to process and respond to requests and inquiries you make to SoftVu.

In addition, SoftVu automatically collects certain information from your computer and browser, such as your web browser, IP address and pages visited on our Sites, as described below.

SOFTVU INFORMATION USE POLICY

SoftVu will not use your information except as described in this Privacy Policy. If SoftVu identifies new purposes for information collection and use, we will revise and update our Privacy Policy to reflect such new purposes. As this Policy is revised and updated, we will note the new effective date of the revised and updated version above.

SoftVu uses the information we collect to provide our Services to you and to fulfill requests and/or answer inquiries you have made to SoftVu. We may also use your information to make our Sites easier for you to use and to inform you of Services updates, new Services and other related information from SoftVu.

SoftVu uses your browser information to analyze trends, administer our Sites, track users’ activities on our Sites, help us understand the parts of our Sites visited most often and gather broad demographic information for aggregate use in improving our Sites. We also may assemble information that we collect into aggregate form (i.e., combine non-personal information obtained from many different users) to better understand how the Sites are being used. We may also use this aggregate information to analyze our website’s utility, enhance the areas and functionality within our Sites that appear to be of interest to various users and better communicate our Services. We also may access and use statistical/historical analyses, aggregations, scoring results, and other analytics generated by our system and make such analytics available to third parties on an anonymous basis (i.e., without including any personally identifiable information).

SOFTVU INFORMATION SHARING POLICY

Except as described in this Policy, SoftVu does not share, sell, rent, loan, trade, lease or disclose your personal information to any third party without your prior consent.

SoftVu may share your information with service providers and partners who participate in and support providing our Services to you or in addressing or responding to your requests and inquiries. SoftVu also may share your information with our service providers to facilitate Targeted Advertising, as described below in the section titled “Targeted Advertising”. In order to operate our website and provide our Services to you, we also may provide personally identifiable, aggregate, and other information associated with our website to third parties that provide services for us, including services such as shipping, payment processing, database management, and Internet services.

We may share your information with another company that controls, is controlled by, or is under common control with SoftVu. SoftVu also may share your information with another company in relation to a sale, merger or consolidation of SoftVu’s assets, or other change of corporate control, provided, however, that such company agrees to honor all of the privacy commitments set forth in this Privacy Policy.

We reserve the right to disclose your personal information as required by law, court order or other valid legal processes or as reasonably necessary for the establishment or maintenance of legal claims.

We may supplement information about you with information obtained from other sources to better serve you and enhance our Services. We may obtain supplemental information from related companies as well as from business partners acting under specific contractual obligations. We endeavor to require that any third-party service providers and partners with whom we share information confirm that their privacy practices are consistent with this Privacy Policy.

FINANCIAL INFORMATION

We may request you provide us with financial information required to facilitate financial transactions you initiate and, in certain circumstance, we may share this information with third parties, under contract with us, to facilitate such transactions. As described elsewhere within this policy, we implement safeguards designed to protect against the unauthorized use, or disclosure, of such information. Financial information provided to us to facilitate transactions is not otherwise used, or retained. Once terms have been established, and such transactions are complete, we destroy or otherwise obscure such financial information.

OPT-OUT OF SOFTVU EMAIL COMMUNICATIONS

SoftVu maintains an email list to communicate with our clients and prospects. Individuals must affirmatively ask to join our email list by opting-in on our Sites. All email messages sent to these lists include an opportunity to unsubscribe or opt-out of receiving future emails. You may also request to be removed from our email list by contacting us by following this link.

COOKIES

SoftVu uses cookies to tailor web content to match your browser capability and for web analytics. Cookies are small text files that are stored by your web browser and store data to make your browsing experience easier and faster. You can set your Internet browser to notify you when you receive a cookie, giving you the choice to decide whether or not to accept it. If you reject cookies, you may still use our Sites, but functionality of some areas may be limited.

For more information about the use of cookies and other similar technology, please visit an information site such as http://www.networkadvertising.org.

WEB BEACONS

In order to determine a user’s ability to receive HTML email in addition to whether or not an email has been opened, SoftVu includes a ‘web beacon” in HTML email messages we send. A web beacon is a small .gif image that is activated when an HTML email is opened via a request for the image on our servers. This capability allows SoftVu to send email in a format users can read and enables SoftVu to track the aggregate number of emails opened. Users that do not want to receive email messages with web beacons can elect to receive their emails in text (non-HTML) format. We also use the capability to track when a URL has been clicked inside of an email message sent by our system. We use this functionality to track which links were clicked and in what quantity, as well as the aggregate number of links clicked. Any personally identifiable information collected via this click tracking functionality will be subject to this Privacy Policy.

ADVERTISING

As you browse the Internet, you may see advertisements on the web pages you visit. SoftVu delivers, and works with advertising partners to enable the delivery of, relevant messages to the right consumers. This is called Targeted Advertising and may be based on a variety of factors, such as: web Sites you visit, perceived interests, and demographic information. Targeted advertising does not result in you seeing more ads, rather the ads you see will be more relevant to you.

SoftVu also may use ad serving companies to place banner ads from other firms on our Sites. Your interaction with these advertisements may generate information associated with you, your computer, or the information related to the content present you were viewing. For more information about online advertising, you may also visit www.aboutads.info.

SECURITY

SoftVu uses physical, electronic and administrative measures to protect against the loss, misuse, and/or alteration of the information under our control. All information is stored securely and may only be accessed by authorized persons with a legitimate business need to access the information. However, we cannot guarantee the security of personal information accessible on or transmitted via the Internet.

LINKS TO THIRD PARTY SITES

Our website may contain links to other websites that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of other such websites, and this Privacy Policy applies only to information collected by us in connection with our Sites.

PARTICIPATION IN SOFTVU PUBLIC FORUMS

Some areas of the Sites allow you to provide content to us directly (a “Public Forum”). By posting content on or through a Public Form, you grant SoftVu a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute your content in any and all media or distribution methods (now known or later developed) for any and all purposes.

Any content you post to a Public Form may be publicly viewed and used by anyone on the Internet. You are responsible for any content you post, and for any consequences thereof, including the use of your content by other users. To protect your privacy, SoftVu reminds you not to submit personal information in a public forum.

You agree not to post any content that (i) is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; (ii) you do not have a right to make available under any law or under contractual or fiduciary relationships; (iii) infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; or (iv) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

SoftVu may pre-screen, refuse, or remove any content that you post. We may also modify or adapt your content in order to transmit, display or distribute it.

SoftVu does not control the content posted by public users to our Sites and, as such, does not guarantee the accuracy, integrity or quality of such content. Under no circumstances will SoftVu be liable in any way for any user-contributed content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any user-contributed content.

CHANGES TO THIS POLICY

SoftVu may revise and update this Privacy Policy from time to time. If we decide to change this Privacy Policy, we will post such changes here so that you are aware of what changes have been made in how we collect, use and disclose your information.
